How To Make A Complaint

If you think we have breached applicable privacy laws, or you wish to make a complaint about the way we have handled your personal information, you can contact us using the details above.

How Do We Process Personal Information When You Send Us Your Application For a Job Offer in the EEA?

To apply for a job with us, you need to provide us with the data required for assessing and perhaps selecting you. The information required in each case can be found in the job description or will be stated specifically in the application form. This includes Personal Information such as your name, address, a means of contact, and proof of the qualifications required for a position with us. Upon request, we will be happy to provide you with the information required for a specific position.

The legal basis for processing your Personal Information throughout the application procedure follows from Art. 6(1), sentence 1, lit. b GDPR in conjunction with applicable EEA Member State law.

Where we collect special categories of Personal Information within the meaning of Art. 9(1) GDPR (e.g. health data, such as the existence of a severe disability, or ethnic origin) from applicants during the application process, to allow us or the applicant to exercise the specific rights in the field of employment and social security and social protection law, such data will be processed in accordance with Art. 9(2) lit. b GDPR in conjunction with applicable EEA Member State law. Where necessary for the protection of vital interests of applicants or other persons, Art. 9(2) lit. c GDPR serves as legal basis. For the purposes of preventive or occupational medicine, for the assessment of the working capacity of the applicant, medical diagnosis, the provision of health or social care or treatment or the management of health or social care systems and services, we rely on Art. 9(2) lit. h GDPR in conjunction with applicable provisions from EEA or Member State law. If we ask for your voluntary and express consent in this respect, we process special categories of Personal Information on the basis of Art. 9(2) lit. a GDPR in conjunction with applicable EEA Member State law.

If your application is successful, your applicant data will be further processed by us to establish, perform and terminate the employment relationship. Otherwise, if the application for a job offer is not successful, the data of the applicants will be retained for future roles unless deletion is requested. We will also erase Personal Information from applicants if they request us to upon withdrawing their application, which they are entitled to do at any time. We will erase Personal Information from the application procedure no later than 14 days after this procedure has been requested. Such storage is necessary to allow us to answer any follow-up questions about the application procedure and to comply with applicable time limits under applicable EEA Member State law. Invoices for any reimbursement of travel expenses will be retained in accordance with tax law requirements under applicable EEA Member State law.

Your Rights As A Data Subject

  • As a Data Subject, you have the right to obtain confirmation as to whether Personal Information relating to you is being processed by us and, where that is the case, the right to access to the Personal Information to you and a copy thereof (Art. 15(1) and (3) GDPR).
  • If we process inaccurate Personal Information, you have the right to rectification (Art. 16 GDPR).
  • In some cases described by law, you may request the erasure of Personal Information concerning you or the restriction of processing (Art. 17 and 18 GDPR).

Verifiable Consumer Requests. Only you, or your agent registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your personal information. You may only make a request for access to your personal information twice within a 12-month period. We may need to verify your identity (and if applicable, your agent’s authority to make the request on your behalf) before we are able to process your request. We will ask you to provide certain information to verify your identity: name, email address, and telephone number. If an authorized agent makes the request on your behalf, then (i) we will need proof that you have provided the agent with power of attorney; (ii) you must provide the agent with signed permission to submit a request to access or delete; (iii) you must verify your identity directly with us; or (iv) you must confirm with us that you provided the authorized agent permission to submit the request.

You must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information. During the verification process, we will try to match the information you provided against known information in our databases. Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password-protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Your request must contain sufficient detail that allows us to properly understand, evaluate and respond to it, otherwise we may not be able to respond to it. If we cannot verify your identity or sufficiently differentiate you from another consumer, or cannot confirm an agent’s authority to act on your behalf, we are not required to fulfill your request.

California residents with an established business relationship with us can request information once a year about sharing their personal information with third parties for the third parties’ direct marketing purposes. Change of Control. Where we collect Sensitive Personal Information within the meaning of the PIPL (e.g. health data, financial data) or transfer your Personal Information out of China we will seek your separate and express consent as required under the PIPL.

We do not knowingly request the Personal Information of any minor under the age of 14 years.

If you decide not to share certain Personal Information with us, then we may not be able to provide, for example, the corresponding information or service requested. With Whom Do We Share Your Personal Information?

If required by the PIPL we will enter into the required contracts with such third parties.

Cross-Border Transfer of Your Personal Information

We may transfer your Personal Information out of China when you apply for a job with WiseTech in China. All exports of Personal Information by WiseTech in China as a Personal Information handler will be conducted in accordance with the requirements of the PIPL and a standard contract as required under the PIPL will be entered into with the overseas recipient.

Your Rights

Subject to any limitations under the PIPL or other applicable PRC laws, you have the following rights with respect to your Personal Information:

  • to obtain confirmation as to whether Personal Information relating to you is being processed by us and, where that is the case, the right to access to the Personal Information to you and a copy thereof ;
  • to request rectification where the Personal Information relating to you is inaccurate;
  • to request the erasure of Personal Information concerning you or the restriction of processing of such Personal Information;
  • if processing is based on your consent, to withdraw your consent at any time, which would not affect the lawfulness of processing based on consent before its withdrawal;
  • to request that we cease processing your Personal Information for direct marketing purposes at any time (including any profiling for such purpose.); and
  • to request that we clarify our Personal Information handling rules.

We do not make any automated decisions based solely on automated processing, including profiling, which produce legal effects concerning the visitors of our Website or similarly significantly affects them.

In the event of the death of a natural person, their next of kin, may exercise the rights to request access, copy, correct, and delete the relevant Personal Information of the deceased, unless the deceased had arranged otherwise before his/her death.
